Privacy Policy

1. About this policy 

UndaTech Pty Ltd (ACN 667 261 243, ABN 17 667 261 243) (UndaTech, we, us) respects your privacy. This policy explains how we collect, use, store and disclose personal information when you use www.undatech.com.au, buy from us, contact us or take part in our research and product trials. We handle personal information in accordance with the Australian Privacy Principles in the Privacy Act 1988 (Cth), and we send marketing messages in accordance with the Spam Act 2003 (Cth). 

2. What we collect 

  • Identity and contact details: your name, email address, phone number, and delivery and billing addresses. 

  • Order details: the products and sizes you buy, order history, and communications with us about orders, returns and fit. 

  • Payment information: payments are processed by Shopify Payments, PayPal and Afterpay. We receive confirmation of payment and, at most, the last four digits of your card. We do not receive or store your full card number. PayPal and Afterpay handle the information you give them under their own privacy policies. 

  • Account details: if you create an account, your login details and saved preferences. 

  • Marketing preferences: whether you have agreed to receive marketing from us. 

  • Website and device information: IP address, browser type, pages visited, referring site and similar data collected through cookies and similar technologies (see section 6). 

  • Research and trial information: if you take part in a product trial or survey, the information you agree to provide in that trial. We will tell you what is collected and why before you take part. 

We do not ask for health information. Your choice of product or size is treated as order information only, is used to fulfil and support your order, and is not shared for advertising purposes in a way that identifies you. If you choose to tell us about a medical or health matter, for example in a fit enquiry, we will use that information only to help with your enquiry. 

3. How we collect it 

The Privacy Act distinguishes between personal information and sensitive information (which includes health information). We do not seek to collect sensitive information through our website. If we receive it, we handle it in accordance with the Australian Privacy Principles and use it only for the purpose for which it was given. If we receive your personal information from a third party, we will take reasonable steps to let you know. 

We collect personal information directly from you when you place an order, create an account, contact us, sign up for emails or take part in a trial. We also collect information automatically through our website, and from service providers who help us run the store, including our ecommerce platform, payment processor and delivery partner. 

4. Why we use it 

  • To process, deliver and support your orders, returns and exchanges. 

  • To answer your questions and provide fit and sizing help. 

  • To contact you about product safety matters, including any product recall or safety notice. We may contact you for this purpose even if you have opted out of marketing. 

  • To send you marketing about our products and offers, where you have agreed to receive it. You can unsubscribe at any time using the link in each email. 

  • To operate, secure and improve our website and understand how it is used. 

  • To detect and prevent fraud and misuse. 

  • To meet our legal obligations, including tax, consumer law and record keeping requirements. 

  • To conduct research and product development, where you have agreed to take part. 

5. Who we share it with 

We share personal information only where needed to run our business, with: 

  • Service providers who act for us, including Shopify (our ecommerce platform), Shopify Payments, PayPal and Afterpay (payments), Australia Post (delivery), email and customer service tools, website analytics and advertising platforms including Google and Meta, and IT and cloud providers. 

  • Professional advisers, insurers and regulators where required. 

  • Law enforcement or government agencies where the law requires or permits it. 

We do not sell personal information. 

Some of our service providers store or process information outside Australia, including in the United States, Canada and the European Union. Before disclosing information overseas we take reasonable steps to make sure it is handled in accordance with the Australian Privacy Principles, including through contractual terms with those providers.

6. Cookies and online advertising 

Our website uses cookies and similar technologies to make the site work, remember your cart, measure how the site is used and show you relevant advertising on other websites. You can block or delete cookies through your browser settings, although some parts of the site may not work as intended. You can opt out of personalised advertising through the settings offered by Google and Meta, and through youradchoices.com.au. 

7. Security and retention 

We take reasonable steps to protect personal information from misuse, interference, loss, and unauthorised access, modification or disclosure. Our website uses encryption in transit, and access to customer information is limited to people who need it. We keep personal information for as long as we need it for the purposes above, including for at least seven years for financial records where the law requires it, and then delete or de-identify it. If a data breach occurs that is likely to result in serious harm, we will notify affected individuals and the Office of the Australian Information Commissioner in accordance with the Notifiable Data Breaches scheme. 

8. Access, correction and complaints 

You can ask to access or correct the personal information we hold about you by emailing contact@undatech.com.au. We will respond within 30 days. If you have a concern about how we have handled your personal information, please contact us first and we will investigate and respond in writing. If you are not satisfied with our response, you can complain to the Office of the Australian Information Commissioner at oaic.gov.au or on 1300 363 992. 

9. Customers outside Australia 

Our website is directed at customers in Australia. We do not target customers in the European Union or monitor the behaviour of individuals there, and the General Data Protection Regulation does not apply to our handling of your information. 

10. Children 

Our website and products are intended for adults. We do not knowingly collect personal information from anyone under 18. 

11. Changes 

We may update this policy from time to time. The current version is always published on our website with its effective date.
